Justice Court

IT IS IMPORTANT THAT YOU READ, UNDERSTAND, AND FOLLOW THESE INSTRUCTIONS.  FAILURE TO DO SO MAY RESULT IN YOUR INABILITY TO PARTICIPATE.

An Arraignment is your initial appearance before the Judge. You will receive a copy of the Criminal Complaint and/or Citation which will indicate the charges made against you, you will be advised of your constitutional rights, and the Court will confirm if your name is correctly spelled on the Criminal Complaint and/or Citation.

In response to the concerns surrounding the spread of COVID-19 (Coronavirus), the Esmeralda Township Justice Court is currently closed to the public.  If you were arrested or cited and are scheduled for a Criminal or Traffic Arraignment, please contact the Court at (775) 485-6359 or jp@esmeraldacountynv.org and a member of our staff would be happy to discuss the options listed below with you.

If Defendant plans to enter a Not Guilty Plea on a Misdemeanor charge or is being charged with a Gross Misdemeanor or Felony, he or she has the option to fill out a “Waiver of Arraignment” form prior to hearing.  If Defendant waives their Arraignment, they do NOT have to appear before a Judge.  Defendant will be set for a Pre-Trial which is a meeting between Defendant, Defendant’s Attorney, and District Attorney to see if the matter can be resolved.  If the matter is not resolved, it will be set for a Trial or Preliminary Hearing at that time.

If Defendant would like to appear before a Judge, all Court Hearings are currently being conducted using the BlueJeans platform.  If a Defendant wants to hold their hearing via BlueJeans, they can opt-in for a virtual hearing.

The Virtual Criminal and Traffic Arraignments are currently being held Monday through Wednesday at 9:00 A.M.  A Court Clerk will email Defendant a video explaining your rights which must be viewed prior to the hearing.  Defendant will also receive their Criminal Complaint and/or Citation accompanied with a BlueJeans link for the hearing.  You MUST have Criminal Complaint and/or Citation with you at that time of hearing.  The Virtual Criminal Arraignment session will open approximately fifteen (15) mins prior to hearing time and Defendants may login at that time.

Additional Payment Information
Please note that courts in the State of Nevada do not send notices of appearance regarding court dates on traffic citations. Your court date is stated on your citation. The court requests you wait a period of two weeks from the time you have received your citation before making a payment online in order to allow internal processing on your case. If your ticket is past its court date, you are responsible for additional fees. If you fail to pay, your ticket will be treated as outstanding by the court and you will remain responsible for those unpaid fees. The court will issue warrants, suspend driver licenses, and/or may report unpaid fees to credit reporting agencies.

If you are making payment for either a traffic citation or a criminal case and a warrant for your arrest has been issued for a failure to appear, failure to pay fine, failure to complete sentencing requirements or for any other reason, your payment will be rejected during the court’s normal operating hours. You must contact the court staff to resolve any outstanding warrants. PLEASE BE ADVISED THAT PAYING ONLINE FOR CASES THAT HAVE ALREADY GONE TO WARRANT WILL NOT PREVENT YOU FROM BEING ARRESTED.

Further, if you make a payment online for a matter filed in another court’s jurisdiction, you are responsible for any pending actions arising from the court of jurisdiction for failure to pay timely. It is not the responsibility of the courts to process payments for other agencies.  Your payment will be rejected with no notice to you.
